THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

NO PURCHASE NECESSARY. The promotion begins at 12:00:01 a.m. Central Time (“CT”) on December 4, 2007 and ends at 11:59:59 p.m. CT on January 2, 2008 ("Contest Period").  Online entries must be received no later than 11:59:59 p.m. CT on January 2, 2007. 

ELIGIBILITY:  The Penn Station Gift Certificate Contest (the "Contest”) brought to you by Penn Station, Inc. ("Penn Station, Inc.”), will be governed by these “Official Rules”.  The Contest is only applicable and open to legal residents of the 50 United States (excluding Florida and New York) and The District of Columbia who are 18 years of age or older at the Contest launch at 12:00:01 a.m. CT on December 4, 2007.  Sponsor reserves the right, at any time, to verify eligibility requirements, in any manner it deems appropriate.  Employees and directors of Sponsor, and any of Sponsor’s parent, corporate subsidiaries or affiliates, or any employees or directors of any Penn Station, Inc. advertising, promotion, or production agencies (and their respective IRS-recognized dependents, immediate family members and individuals residing in their same household) are not eligible for Contest.  By participating, entrants agree to these Official Rules.  Void in Florida, New York and where prohibited. 

HOW TO ENTER: Visit the Penn Station web site at http://www.penn-station.com/gift2007.php, and submit the form. One entry per person per day; limit one prize per person per game. All entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigned e-mail addresses for the domain associated with the submitted e-mail address. Penn Station and its agents are not responsible for incomplete, lost, late, damaged, illegible or misdirected e-mail/U.S. mail; for technical, hardware, or software failures of any kind; lost or unavailable network connections; or failed, incomplete, garbled or delayed computer transmissions which may limit a user's ability to participate in the contest. All winner notifications in the contest will be sent by e-mail. We are not responsible if your e-mail does not work. Penn Station reserves the right to cancel or modify the contest if fraud or technical failures destroy the integrity of the contest as determined by Penn Station in its sole discretion. If the contest is so canceled, any and/or all announced winners will receive prizes to which they are entitled as of the date of cancellation; the unawarded prizes will be donated to charity. Sponsor reserves the right to validate all entries in any manner it deems appropriate.  Entries that are found to be not eligible (as solely determined by the Sponsor) will be deemed void and the participant will be disqualified.  THERE IS NO PURCHASE NECESSARY TO ENTER.  Sponsor is not responsible for lost, late, mutilated, misdirected, illegible, incomplete or postage due mail, or for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature.   Please see the Website's privacy policy for details of our policy regarding the personal information collected in connection with this game. Automated entries are prohibited, and any use of such automated devices will cause disqualification.. 

DRAWING AND PRIZES: There will be a random drawing from among all eligible entries which will occur within 15-30 days of the completion of the Contest Period.  The drawings will be conducted by a representative of Sponsor whose decisions are final and binding.  The Prizes available to be awarded are as follows: (5) Penn Station Gift Certificates worth $100; Winners will be notified by Penn Station, Inc., by email and prizes will be shipped within 4-6 weeks of notification.  Odds of winning a prize depend upon the number of eligible entries received.  Prizes cannot be assigned, transferred, redeemed for cash or substituted; however, Sponsor reserves the right to substitute any prizes with a prize of equal or greater value, if advertised prize becomes unavailable.  Should a prize be won by a minor in his/her jurisdiction of primary residence, all   affidavits, releases and undertakings, set forth in these Official Rules must be executed and undertaken by the parent/legal guardian of the minor, both on behalf of themselves and the minor.  Prize may be awarded in the name of, or to, minor winner’s parent/legal guardian. 

CONDITIONS OF PARTICIPATION:  Participants agree (a) that Sponsor and its parent, subsidiary and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, are released and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Contest or Contest-related activities and (b) except where legally prohibited, Winners grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, photograph, likeness, voice, image and biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval.  Winners may be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful, Publicity Release.  If documents are not signed, or if Winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and an alternate winner selected.  Taxes on prize are solely Winner’s responsibility.

CONDITIONS AND RESTRICTIONS: Falsifying any data or any other fraudulent activities in connection with this promotion will result in all Awards or prizes being denied, including but not limited to, termination from eligibility for this and all future similar Sponsor promotions in Sponsor's sole discretion.  Persons who tamper with or abuse any aspect of the Contest or Web Site, or who are in violation of the Terms and Conditions of Use of the Web Site, as determined by the Sponsor in its sole discretion, will be disqualified.  Sponsor may also prosecute such persons to the full extent of the law. Should the online portion of the Contest be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness, proper play, or submission of entries for the Contest, Sponsor reserves the right at their sole discretion to suspend, modify or terminate the Contest and award prizes in a random drawing from eligible entries received at the time of such action.  Sponsor and their agencies are not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of the Web site.   This Contest will be governed by and interpreted under the laws of the state of Ohio, without application of any conflicts or choice of law rules.  By participating, all participants consent to the jurisdiction and venue of the federal, state and local courts located in Cincinnati, OH.
